WARRANTY TERMS AND CONDITIONS FOR AUTO REFINISHING SERVICES

 

1. RESOLUTION OF DISPUTES. HALSEY AUTO COLORS AND CLIENT MUTUALLY AGREE THAT ANY DISAGREEMENT OR CLAIM RELATED TO THIS SERVICE AGREEMENT OR VEHICLE REFINISHING WORK SHALL BE ADDRESSED THROUGH THE FOLLOWING PROCESS: BOTH PARTIES SHALL INITIALLY SEEK RESOLUTION THROUGH GOOD-FAITH MEDIATION CONDUCTED BY A NEUTRAL MEDIATOR FROM THE AMERICAN ARBITRATION ASSOCIATION, FOLLOWING THEIR ESTABLISHED MEDIATION GUIDELINES. SHOULD MEDIATION FAIL TO RESOLVE THE MATTER, BOTH PARTIES CONSENT TO FINAL AND BINDING ARBITRATION THROUGH THE AMERICAN ARBITRATION ASSOCIATION, CONDUCTED ACCORDING TO THEIR STANDARD ARBITRATION PROCEDURES. THE ARBITRATOR'S DECISION SHALL BE FINAL AND MAY BE ENFORCED IN ANY COURT WITH PROPER JURISDICTION. ANY ARBITRATION SHALL BE CONDUCTED INDIVIDUALLY; NO CLASS ACTION OR REPRESENTATIVE CLAIMS SHALL BE PERMITTED. CLAIMS ARISING UNDER THE MAGNUSON-MOSS WARRANTY ACT SHALL BE SUBJECT TO MEDIATION BUT NOT ARBITRATION. IF SUCH CLAIMS REMAIN UNRESOLVED AFTER MEDIATION, THEY MAY BE PURSUED IN COURT. BOTH PARTIES WAIVE JURY TRIAL RIGHTS FOR ANY COURT PROCEEDINGS.

 

2. Service Warranty Coverage. Halsey Auto Colors guarantees our refinishing work against deficiencies in craftsmanship and materials for the duration specified in Section 2(A). Throughout this period, we will correct or redo any work that fails due to faulty application or defective materials at no additional cost for labor or materials, subject to the conditions outlined below. All warranty service must be completed at our facility or at a pre-approved service location if the vehicle is outside our service area.

   A. Coverage Duration and Transfer Restrictions. This warranty protection applies exclusively to the original client for the duration of their vehicle ownership. This warranty cannot be transferred to subsequent owners or assigned to third parties.

   B. Third-Party Components and Materials. When utilizing paints, primers, clear coats, or other materials sourced from external manufacturers, our warranty coverage extends only as far as the manufacturer's warranty provisions that apply to our business.

   C. Coverage Exclusions. This warranty does not cover issues arising from circumstances outside our control, including but not limited to: damage from unauthorized modifications or repairs, inadequate vehicle care, improper use of the vehicle, accidents, alterations by others, subsequent work by non-authorized facilities, owner negligence, natural disasters, or force majeure events. Disputes regarding coverage exclusions shall follow the resolution process in Section 1.

   D. Environmental and External Damage. This warranty excludes damage from environmental factors including chemical exposure, organic matter (tree sap, bird droppings), road treatments, gravel impacts, weather events, UV exposure, atmospheric pollutants, and similar external factors affecting paint, clear coat, trim, or other finished surfaces.

   E. Parts Retention Policy. By accepting these terms, the client releases any claim to removed or replaced components, which become property of Halsey Auto Colors. Clients wishing to retain replaced parts must notify management prior to signing this agreement.

 

3. WARRANTY LIMITATIONS. THE WARRANTY DESCRIBED IN SECTION 2 CONSTITUTES THE COMPLETE WARRANTY FOR SERVICES PROVIDED BY HALSEY AUTO COLORS AND REPLACES ANY OTHER WARRANTIES OR GUARANTEES, WHETHER VERBAL OR DOCUMENTED. NO ADDITIONAL EXPRESS WARRANTIES ARE PROVIDED. HALSEY AUTO COLORS SHALL NOT BE RESPONSIBLE FOR ANY INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES INCLUDING BUT NOT LIMITED TO LOST INCOME, LOST OPPORTUNITIES, OR COMMERCIAL LOSSES, REGARDLESS OF PRIOR NOTICE OF SUCH POTENTIAL DAMAGES. WHERE LOCAL OR STATE LAW CONFLICTS WITH THESE TERMS, APPLICABLE LAW SHALL PREVAIL.

 

4. Complete Agreement and Modifications. The client confirms that no promises or guarantees outside this document influenced their decision to authorize services. This document represents the complete understanding between Halsey Auto Colors and the client, replacing all prior agreements or communications regarding the services. Any changes must be documented in writing and signed by both parties, whether through traditional or electronic signature methods.
